Orange police observe a pickup truck traveling with an expired inspection sticker at 12:53 am. After signaling truck to stop, police detect the odor of an alcoholic beverage coming from client along with glassy eyes. Client initially denies having had anything to drink, but then admits to a “hint”. After further questioning, client admits to a couple of beers and then again changes the amount to three beers – all within the last hour. Client fails the HGN test. After failing the walk and turn test, police allow client to remove his boots and try again – resulting in another failure. Client fails the one-leg stand test – after attempts on both legs. Client fails a preliminary breath test, blowing a .115.
